Abstract

The rules of form and procedures are among the most important rules that the administration issuing the administrative decision must abide by, and the most important conditions for the administrative decision. This is because the administrative decision must follow certain procedures and forms that differ from one decision to another, and its importance to the administration lies in not rushing and issuing hasty and improvised decisions, and in this it achieves the interest of the administration and individuals. The good functioning of the public facility and the regularity of administrative activity alike were achieved, and the importance of this study comes in differentiating between form and procedures and distinguishing between what is included in the form and what is included in the procedures, and to identify cases in which the administrative decision is flawed by the defect of the form and procedures. As well as the distinction between the form and the essential procedure and the form and the secondary procedure, where the administrative decision is void in the first case and subject to cancellation on the grounds of cancellation, which is not so in the second case.

     Through this study, we learn about the procedures and forms whose negligence by the administration leads to the invalidity of the administrative decision and its ability to be rescinded on the grounds of cancellation, as well as the procedures and forms whose violation by the administration when issuing administrative decisions issued by councils and committees leads to the invalidity of the administrative decision and its susceptibility to cancellation on the grounds of cancellation, as well as Procedures and forms related to disciplinary decisions and their legal basis.
