Abstract

This research critically examines the judicial organization in Yemen's draft federal constitution, revealing a disturbed constitutional philosophy due to an inconsistent mix of different judicial models. It highlights key issues: the ambiguity of the Supreme Federal Court, the absolute independence of regional judiciaries at the expense of legal system unity, excessive referral of details to subsequent laws, and a constitutional void regarding the judiciary in the federal capital, Sana'a. It concludes by proposing an alternative vision to balance judicial independence with the unity of the federal legal system.
