Abstract

The technological revolution has led to the emergence of modern crimes, most notably those resulting from the actions of artificial intelligence (AI). The machines have become capable of making independent decisions, yielding significant benefits. However, this has also given rise to the possibility of committing new types of cybercrimes. This necessitates clarifying the concept of artificial intelligence and defining the criminal liability arising from its actions and characteristics. This study affirms the flexibility of Islamic law and its remarkable capacity to accommodate modern developments and address crimes committed using artificial intelligence. It also clarifies the implications of criminal liability for AI-related crimes. Furthermore, the study recommends the establishment of an international charter to regulate AI technologies, the adoption of a clear concept of criminal liability, and the development of criminal legislation principles to keep pace with the rapid evolution of these crimes.
