Protecting the Author Intellectual Rights in the Yemeni Legalization Comparing with Other Legalizations

Abstract

No one disagrees with the importance of the Author's intellectual and literary rights or what is known as the intellectual property, and their relation in building the relationships between the nations and the societies. Especially during the development of the technology and the fast communication through the net web which plays an essential role in communication, sharing the information, copying the intellectual works and sending them through the cyberspace in a so fast and unique way. As a result, the scope of the intellectual rights protection became wider. In addition, there is increasing in the number of the question about the ability of these Legalizations to match these huge and fast technology developments in order to create the balance between protecting the authors' rights and the free using of their works by their readership. The research tries to find answers for all of these questions in the Yemeni Legalizations and the other Legalizations.      

Researcher selected this topic for its importance, to stand on its rules, to gather its parts, to spread the awareness about it due to the Yemeni law ignores it and to present suggestions to modify the Yemeni Legalizations to match with continuous development of the technology and the era in which we live. The Yemeni Legalization includes laws to protect the authors' rights and the ways of announcing them in safely ways. Also, it gives the right to the authors to be compensated for all the concrete and abstract affects. In the other side, it punishes the criminals by full/part-punishments. However, these rules are not matching with electronic attacks against the authors' rights. And these protection rules can be attacked by the hackers/ crackers easily. So, These topics form the center of this study.
